Terms of Service

These Terms of Service (the "Terms") set out the conditions of use for the online shop service (the "Services") provided by BIMMER+ ("we" or "us"). Users ("you") shall use the Services in accordance with these Terms.

Section 1 — Applicability

These Terms apply to all matters relating to the use of the Services between you and us.

Section 2 — Registration and Orders

  1. You are deemed to have agreed to these Terms at the point you apply for registration in the manner we specify, or proceed with a product purchase.

  2. We may decline registration or refuse to accept an order, without any obligation to disclose the reason, if any of the following apply: (1) False information is provided at the time of registration or order; (2) The applicant has previously violated these Terms; (3) Any other case where we determine that the registration or transaction is not appropriate.

Section 3 — Shipping and Product Fitment

  1. To ensure consistent product quality, all items are inspected at our partner warehouses before being shipped.

  2. Estimated delivery time is typically 2 to 4 weeks. Delays may occur due to logistics, weather, customs clearance, or country-specific conditions. Order cancellations due to such force-majeure delays will not be accepted.

  3. It is the customer's responsibility to verify product fitment for their vehicle. Returns or refunds for fitment-related issues will not be accepted.

Section 4 — Prohibited Acts

You shall not engage in any of the following when using the Services: (1) Acts that violate laws, public order and morals, or these Terms; (2) Acts that destroy or interfere with our servers or network functionality; (3) Unauthorized reproduction or use of our content (images, text, etc.); (4) Placing orders or making payments using false information; (5) Any other act we determine to be inappropriate.

Section 5 — Limitation of Liability

  1. We shall not be liable for any vehicle damage, accidents, injuries, or incidental costs such as labor fees that arise during product installation. We strongly recommend that installation be performed by a qualified professional with the appropriate expertise.

  2. Our liability for non-performance shall be excluded except in cases of willful misconduct or gross negligence on our part.

  3. In any event where we are liable, our liability shall be limited to ordinary damages and capped at the purchase price of the product in question.

Section 6 — Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.

  2. Any disputes arising in connection with the Services shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
